Welcome to the website (the “Site” or “cirquecoffee.com”) of Cirque Coffee Roasters ("Cirque," “we,” or “us”). Cirque Coffee provides its services and products to you under these Terms and Conditions of Sale ("Terms"). By accessing or using our Site, you agree to these Terms.

When you place an order or use any Cirque Coffee service, you are also bound by all applicable policies and guidelines, including our Privacy Policy, which is incorporated into these Terms.

Cirque Coffee reserves the right to update or modify these Terms and the Site at any time, at our sole discretion. Continued use of the Site after such changes constitutes acceptance of the updated Terms.


1. Electronic Communications

By clicking “I Agree” or completing a purchase on our Site, you:

  1. Consent to receive all communications and documents electronically.

  2. Acknowledge that clicking “I Agree” constitutes your electronic signature, which has the same legal effect as a handwritten signature.

  3. Confirm that you have access to the Internet, a valid email address, and a device capable of viewing, printing, or saving these Terms.

  4. Agree to print or save a copy of these Terms for your records.

You may withdraw your consent to electronic communication or request paper copies at any time by updating your account profile or contacting us. We will confirm once your request has been processed.


2. Your Account

You may create an account during checkout to simplify future purchases. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Cirque Coffee is not liable for any unauthorized use of your account.


3. Order Acceptance

Placing an order on the Site does not guarantee acceptance. Cirque Coffee reserves the right to refuse or cancel any order at its discretion. We may require additional information to process your order. Once your payment has been authorized and your order accepted, we will prepare your order for shipment.


4. Pricing and Availability

All prices are listed in U.S. dollars. Prices, shipping rates, and taxes may change at any time without notice. Taxes may vary based on your shipping address or changes in local tax laws.

All items are subject to availability. Cirque Coffee may impose quantity limits, cancel orders, or discontinue products at any time. If an item is unavailable after purchase, you will receive a full refund for that item.


5. Payment Methods

We currently accept Visa, MasterCard, Discover, American Express, and Shop Pay. By submitting your order, you confirm that you are authorized to use the selected payment method and authorize us to charge the total order amount, including taxes and shipping fees.

If your payment method is invalid, unauthorized, or cannot be verified, your order may be delayed or canceled.


6. Credit Card Security

We prioritize the security of your personal and payment information. Cirque Coffee uses secure, PCI-compliant payment gateways to process all transactions.

Cirque Coffee does not store credit card numbers or sensitive payment data on its servers. Any stored payment information is handled securely by our payment processors.


7. Sales Tax

Sales tax is charged as required by law. Your purchase may be subject to use tax if your state requires it. You are responsible for reporting and paying any such taxes directly to your local tax authority when applicable.


8. Shipping and Risk of Loss

We ship all in-stock items within two (2) business days. Our business hours are Monday to Friday, 9 a.m. to 5 p.m. Central Time.

Shipping is handled by independent carriers. Standard delivery typically takes 3 to 8 business days after shipment. Shipping costs are displayed at checkout and are your responsibility unless otherwise stated.

All orders are shipped FOB shipping point, meaning that title and risk of loss transfer to you when the order is handed to the carrier. Cirque Coffee is not responsible for delays or damages occurring during shipment.


9. Returns and Refunds

We want you to be satisfied with your purchase. Please review our full Return and Refund Policy for details.

In summary:

  • Coffee cannot be returned due to its perishable nature.

  • Merchandise and Brew Gear may be returned within 30 days if unused and in original packaging.

  • You are responsible for return shipping costs unless the item is defective or damaged.

To initiate a return, contact us at info@cirquecoffee.com with your order number, items you wish to return, and reason for return. We will reply with instructions.


10. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for details on how Cirque Coffee collects, uses, and protects your personal information.


11. Errors and Corrections

We make every effort to ensure the accuracy of information on the Site. However, product descriptions, pricing, and availability may contain errors. Cirque Coffee reserves the right to correct such errors and adjust or cancel orders accordingly.

If you receive a product that does not match its description, your remedy is to return it unused for a refund or exchange.


12. Limitation of Liability

Cirque Coffee will not be liable for lost profits, loss of business, or any indirect, incidental, or consequential damages, even if advised of the possibility. Our total liability to you for any claim shall not exceed the amount paid for the product that gave rise to the claim.

Some jurisdictions do not allow certain limitations, so these provisions may not apply in those areas.


13. Warranties

Products are sold “as is.” Cirque Coffee makes no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.


14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of law principles.

Any dispute arising from or related to these Terms shall be resolved exclusively in the state or federal courts located in Tulsa County, Oklahoma. You consent to the jurisdiction of these courts.
